Perspective of Ijarah Contract Analysis in the Compilation of Islamic Economic Law

Abstract


The study of the ijarah contract in the Compilation of Islamic Economic Law (KHES) is important considering its strategic role in modern Islamic economic practices. KHES as a national legal reference in the field of Islamic economics seeks to accommodate sharia principles in a normative form that can be implemented. However, to ensure the conformity between normative texts and the principles of muamalah fiqh, a critical analysis of the structure, requirements, and practices of the ijarah contract as stated in KHES is needed. The purpose of this study is to study and analyze the regulation of the ijarah contract in the Compilation of Islamic Economic Law (KHES). This study uses a library research method by reviewing various relevant literature related to the perspective of the ijarah contract in the Compilation of Islamic Economic Law (KHES). Research results Implementation and Settlement of Ijarah: The implementation of ijarah must be carried out in accordance with the provisions agreed upon in the agreement. Settlement of ijarah includes the responsibility of both parties to the leased object, including damage that may occur during the lease period. Relevance in Islamic Economics: Ijarah has an important role in Islamic economics, as it provides an alternative for people to benefit from goods without having to own them directly. This is in line with the principles of efficiency and justice in economic transactions.
