HUKUM PEMERINTAHAN DAERAH DALAM TATA KELOLA LOKAL
Abstract
This research endeavor aims to examine the influence of local government laws on local governance and the application of good governance principles in the context of local administration in Indonesia. The methodology adopted for this investigation is a normative legal approach, combining legal frameworks and conceptual analysis. The data used in this study were obtained through comprehensive library research, which includes primary legal documents, particularly the 1945 Constitution and Law Number 23 of 2014 concerning Regional Government, in addition to secondary legal sources in the form of scientific books, scientific journals, and related research results. The findings reveal that local government laws have an important function as a normative basis for the implementation of regional autonomy, delineating the distribution of authority between the central and regional governments, and as a mechanism for fostering democratic, transparent, accountable, and participatory local governance. Furthermore, the implementation of good governance principles, which include transparency, accountability, public involvement, effectiveness, efficiency, and adherence to the rule of law, has proven to be a crucial determinant in improving the quality of public services and local government performance. However, the realization of these principles continues to face numerous obstacles, such as limited institutional capacity, inadequate human resources within the bureaucratic framework, and inadequate public oversight and engagement. Therefore, strengthening the regulatory framework, undertaking bureaucratic reform, and enhancing the capacity of local governments are crucial to facilitate the achievement of effective and sustainable local governance.
