KESESUAIAN TEORI LEGISLASI DALAM PEMBENTUKAN PERATURAN DAERAH DPRD KOTA PADANG

Abstract

The formation of legislation constitutes a fundamental instrument for realizing the rule of law, particularly in ensuring normative coherence, legal certainty, and democratic accountability within decentralized governance. Despite the well-established framework of legislative formation theory, empirical studies that critically examine its operationalization at the regional level remain limited. This study seeks to analyze the extent to which Ahmad Yani’s legislative formation theory is reflected in the practice of drafting Regional Regulations (Perda) within the Padang City Regional House of Representatives (DPRD). Employing a juridical normative–empirical research design with a qualitative approach, the study integrates statutory analysis, doctrinal review, and in-depth interviews with legislative actors involved in the Perda formation process. The findings reveal that the procedural stages of Perda formation covering planning, drafting, deliberation, enactment, and promulgation demonstrate substantial conformity with the theoretical framework proposed by Ahmad Yani. Identified procedural adjustments function as contextual adaptations to institutional structures and administrative realities at the regional level, without eroding the core normative principles of legislative theory. Theoretically, this study reinforces the applicability of legislative formation theory within the context of regional autonomy, while practically offering a normative–empirical reference for strengthening the quality, consistency, and societal responsiveness of regional legislative processes.
