ANALISIS SUBSTANSI NASKAH AKADEMIK PERDA DPRD SUMATERA BARAT

Abstract


Academic manuscripts constitute a legal-scientific instrument with an epistemic function in bridging legal norms and social realities in the formation of regional regulations, particularly those initiated by Regional People’s Representative Councils (DPRD). Although normatively positioned as a mandatory prerequisite, legal scholarship indicates that academic manuscripts at the regional level are often reduced to administrative documents, thereby obscuring their role as the rational foundation of legislation. This study aims to examine the drafting techniques of academic manuscripts for DPRD-initiated regional regulations in West Sumatra Province over the past three years and to assess their implications for the quality of the resulting legal norms. Employing a qualitative descriptive method with normative juridical and empirical approaches, this research analyzes academic manuscripts and draft regulations, conducts in-depth interviews with members of the Regional Regulation Formation Body, and reviews legislative theory literature. The findings reveal that while the structural format generally complies with Law Number 12 of 2011, fundamental weaknesses persist in legal problem construction, sociological argumentation, and normative consistency. This study enriches legal scholarship by reaffirming academic manuscripts as essential scientific instruments that shape legislative rationality, legitimacy, and legal certainty in regional law-making.
