Metode Ijtihad Fatwa Lajnah Bahtsul Masail Nahdatul Ulama Tentang Hukum Thalaq Mu’allaq

Abstract


This study examines a husband and wife who quarreled to the point of threatening thalaq. In households, quarrels often occur that can lead to divorce. Thalaq is an absolute right owned by the husband. Thalaq often occurs with threats is thalaq mu'allaq. Here Lajnah Bahtsul Masail answers the problem by issuing a fatwa with the Nahdatul Ulama ijtihad method. There are three questions raised regarding the quarrels that occur in the household so that the words thalaq. This research uses a normative approach with a literature method. The data sources used are secondary data sources and this research is analysed descriptively. The result of this research is that the question from the fatwa asked by someone is included thalaq mua'allaq because of the simile if and if. Because there are words ‘if’. The method used by Nahdatul Ulama in resolving this issue is the manhaji method, which refers to established sources of Islamic law and the rules used by the Mazhad Imams and refers to the opinion of Wahbah az-Zuhaili.
